Been having some problems with my eyes (recurring problem) im afraid..so they're ta,ing a litle longer than i would have liked;

They both look good, although I think that Tigra probably gets into more trouble than the Spider-Woman. She looks like she's just been misbehaving....

I agree that cropping the images does sometimes mean they work a bit better at avatar size.

Hey Mike!

If you do not have a flat panel monitor for your computer, get one. They make all the difference in the world. My eyes used to go buggy all the time if I spent too much time at the computer. I have not had that problem at all since I got a flat panel(s).

flat panel monitor - check. My eyes have been weakened since i had ross river virus for a year or so, so anythign like drivbing, drawing, computer use tends to hurt after a while. But weirdly, i dont need glasses...

Its got nothing to do with lawyers, but the law. Lawyers just interpret and argue whether or not something infringes or doesn't infringe. You can always find a horde of attorneys to argue whichever point you want to make. The copyright and trademark laws were propogated by politicians.

As for whether its a parady, without much thought I would say its not worth the risk. First, a large comic company's attorneys could just financially bankrupt a lone person. It would cost tens of thousands of dollars to defend a suit. Also, I know that in the EU, a plaintiff can bring suit and if they win, seek their attorney fees (the US only allows this in special situations). I believe that also is the case for Australia. Second, you would have to change the name because DC has trademarked the name "Year One". Note there is no parady defense for a trademarked name. That leads right into what I see as the main problem: I believe that many costumes/names are trademarked as well as copyrighted. Thus you can't get around it by using a parady defense.

There you go then. That was me (albeit tinkered with a little by a Times staffer and sub, no doubt). I think I have the cutting in a file somewhere. I love trademark stories, for some reason. We had one guy who tried to trademark 'Jesus', one who tried to trademark 'Fook' and ran into difficulties when the judge gave due consideration to the ears of sensitive Yorkshiremen. Good ones don't come along all that often, but when they do they are great.

And there would be no liklihood of confusion between a "Year One" comic book and a school using "Year One" to refer to its first grade. Thus no damages. And don't get me started on the EU not recognizing dilution as a possible damage to a trademark. I once read a great Note on the subject written by one of the world's greatest legal scholars.

However if the mark becomes so succesfull it can transcend only being protected against competitors. The "Mc" in McDonalds basically can not be used for anything (there is a famouse case involving a hotel chain called McComfort or something - they lost). Also, while not a case, the owners of Godzilla aggressively protect the mark. There was a sushi restaurant in NYC called Godzilla Sushi who received a cease and desist letter. They are now "Monster Sushi" and they proudly display the letter.

Mr Justice Laddie was a top class judge, who could always be relied on to give entertaining judgments. He once waved an Arsenal Football Club scarf in court during a passing off action. Sadly, he grew bored with the judging life and went back into practice.

On a side note, one of our Appeal Court judges is called Lord Justice Judge. When clients ring up querying it, we have to assure them it is correct. Then they think we're really winding them up when we tell them his first name - Igor.

On the legal subject, I was bored so I did some google searches and found this write up which discusses fan based stories.

"If I make up my own stories, but base them on another work, my new work belongs to me."
False. U.S. Copyright law is quite explicit that the making of what are called "derivative works" -- works based or derived from another copyrighted work -- is the exclusive province of the owner of the original work. i'm kinda just painting them on acetate now rather than pencil colouring. I'm still leanring pencil clouring and it doesnt look good enough to me. The acetate looks great. Plus it suits the cartoony nature of it more - the penicl with the shading and all doesnt fit - they're cartoons - not sposed to have depth ;)
