View Full Version : I think I might have an artist problem

Last month at the Emerald City Comic Con, I got in early on a certain artist's list, I was #4 on his list. He asked for my cel number and he said he'd call when (and if) he got it done. No Problem.

So the next day I go up to him just to check in on the progress of my piece, he hadn't gotten to it yet. He was still working on what he said was the second piece on his list. I wasn't feeling confident that he would get to my request by the time the show ended at the rate he was working so I said I'd check again later. Well about an hour later I got a call from our house sitter about our dogs acting up and so my wife and I decided to leave the con and head home to relieve the sitter.

Shortly after I get home I get a call from the artist saying he got my piece done. I had a laugh and told him I had already left the con but that I still wanted the piece and asked him if he would be willing to ship it to me if I sent him payment thru PayPal. He agreed and not five minutes after the call I sent him payment for the art and extra to cover shipping and for his trouble of doing this for me. He e-mailed back 2 days later saying he received the payment and that he would ship out the art that week with insurance.

It's now a month later and I still haven't received the art. I've sent him a polite e-mail once a week for the last three weeks with no reply from him. I called his cel phone last night and left a voice mail but still no reply.

What should I do in this case? Dispute the Paypal payment? Continue to patiently wait?

At this point you should get double back just for interest on your money he has been holding all this time.

I always get worried about stuff.
I paid for something last Monday and it was posted Tuesday and its not turned up yet.

I mean its got to be next day delivery from USA to Uk right??

Think its just my nature to worry about stuff.

But any thing over two weeks and no replay from the shipper i would be putting a claim into paypal

Ok, I didn't originally want to name the artist but after multiple e-mails(to two different e-mail accounts), voicemails and a message to his Facebook account I still haven't heard from him.

So if anyone here knows Mark Brooks personally, point him to this thread.

Jeez, I always got the impression he was too busy to be doing anything, including going to the post office. I think his wife Lisa generally handles his artwork sales and stuff. I'm surprised she hasn't gotten back to you. She's pretty friendly to deal with too. Timely is a different story though. I had to wait 2 weeks to get a response for an inquiry about a piece of already finished and published art (which turned out to have been sold anyway).

Its really hard to get a hold of Mark. I have tried a few times. Lisa always answers and its very hit and miss.

Good luck though man. His stuff is awesome.

I am sure he hasnt got around to it and simply forgotten. I know that is not a good excuse but I dont think hes shafted you.

His wife seemed pretty friendly. Judging from the emails anyway.

How bizarre. I mean, he was already prepared to hand you the finished commission at that con. And now, the disappearing act. Finished or not, it seems awfully rude, insensitive, and dismissive to leave you hanging like that. Unless he was hit by a truck leaving the con and has since been hospitalized, I don't understand why he would ignore your communiques. I sure hope he hasn't sold your commission to someone else at the con, thinking he could simply do another for you at home.

I can't assume to know the truth, however, there generally appears to be a poor time management and responsibility issue with so many artists today.

Sadly, we pretty much how this is going to end. Ultimately, you will get your commission. You will also get an apology and explanation. And, next week, we'll hear a very similar story from someone else.

All this to say, I wouldn't worry.
Your commission will come.

Mark has finally gotten back in contact with me and explained his situation and it looks like our issue will be resolved very soon.

Good to hear he is looking after this. I do know that a few weeks after ECCC he was travelling up here to the Calgary Con and that would take a few days out.

Be sure to post the piece for us when you get it!
