In acutality, ACM is 100% right! I have been inundated with dealing with local government. It seems that the city of White Plains, NY had received a complaint from some elderly woman that we were blocking the street and from that point on the city started issuing tickets, $35 each and multiple times a day. I must of had 10 of them in a week. And I wasn't the only one. All together we had over 50+ tickets in week, up and down the street. The city is claiming that my entire street, which is a few blocks long, consisting of 30+ homes were all at fault. They insist that our driveways, that we have been parking on forever, my family for over 25 years without a ticket, is actually public sidewalk and we are no longer allowed to park on them.
Here is a pic of my street. The blue car on the lefy and the three garage doors are mine. There is another garage door to the left of my car and all of the black top is my driveway. I have to shovel it, resurface it and insure it and have done so for 25 years. Now they are saying that where my car is parked in the pic, I am parked illegally on a sidewalk. Also remember in the City of White Plains there is no parking overnight on any street between the hours of 12am and 6am. So the other side is out of the question. And during the day its only 1hr parking.

Anyway here we go, I went to speak to the Traffic Bureau, and I rallied all the ticketed homeowners to go with me. They saw the hoard of angry people and they sent me to the Police Tour Commander. He saw the hoard of people and then he sent me to the Police Captain of the Traffic Division. His secretary told be to go talk to the Traffic Bureau. LOL! Which was where I started. So I told her to just give me the Mayor's Office number. Two secs later the Captain was on the phone. He met me at my street and told all of us the same Mumbo Jumbo. So I rallied the troops again and went to court to fight the tickets. I filled the court room with residents and wrote a letter explaining the situation. I CC'ed the Mayor, Congresswoman, Police Commissioner, the courts, the City Council, The Traffic Commissioner, all the News Papers, Channel 12 News Local and ABC Channel 7. I provided dozen of pictures and arguments. I also provided in the package with the letter and pics a petition to get our driveways back, signed by all the homeowners and residents of the entire avenue as well as those whose avenues join ours, because they are most certainly to be the next victims. All the tickets were dismissed by the judge. But its still not over....we still had to fight City Hall now to relinquish their hold on our street.
After a few days I attended a traffic commission meeting which turned out to be fruitless. There were some members of the commission trying to tell us to park over night at our local Galleria Mall. Yes it is close, but not close enough to park. It is over a half mile away and our street is a 35 degree hill that is over a mile long. So in essence they want a 70 year old woman or a 35 year old RN (she is my neighbor) to park in a deserted Mall garage that has no security at the time since the Mall is closed, when they come home from work at 1am in the middle of winter and walk back uphill in a snowstorm. I was shocked to hear it! And I didn't stand for it. And neither did my neighbors who were in attendance. So a yelling match ensued! LOL! The meeting then came to an end abruptly if you could imagine.
As ACM stated earlier, I was interviewed by New 12 Westchester and a few other entities. (And I didn't even get to see it. LOL! But if ACM is right and it added 10lbs. I don't think I want to! :D)
I then scheduled a meeting one on one with the Traffic Commissioner a few days later. After a few hours of deliberation we got on the same page and are trying to come up with ideas of how to rectify the situation. he still doesn't want to give our driveways back. He is adamant that our driveways are sidewalk and not driveways. I argue, if you were pushing your child in a stroller up the street, which side would you choose to do it on. The DRIVEWAY SIDE or the PREDEFINED SIDEWALK SIDE! LOL! He agrees, but says the city has to look out for those few that have a lack of common sense. To me its just Natural Selection! LOL!
So still nothing is resolved and I how I became the elected spokesperson for the street I have no idea, but my job is far from over. I have a few City Council meetings to attend this month and I have to provide more signatures, property line blueprints etc. It's basically the city officials saying they want blanket laws for the city because it makes it easier for them. And they don't want to set a precedent of making an exception where it is truly needed because then they will have to look at all residents situations individually. My answer to them was, "That is your job! You were elected and/or appointed to make the city better for its taxpaying residents! Not make your job easier for you!" I hope it sunk in!
Anyway it has been a literal living hell. And all that being said, I had to try and do my own work. And that suffered greatly. All in all the wheels of justice move slowly and stupidity lurks around every corner trying to derail it. Got to keep fighting the good fight! I will keep you posted.
Thank you all my SF family for the great sentiments and I missed all of you as well. You all provide for me a great release of stress and add an immeasurable amount happiness to my daily life.
You all are the best and makes this forum what it is,......a family! :thumb2:

Damn that is pain. Dealing with local government is like pulling your own teeth. You give one of these blockheads a taste of power and they feel the need to wield it like Excalibur. God forbid they actually have to do a bit of work for the people the serve.

I did! And told them to narrow the street, make it one way and extend our driveways and we will pay them fro the property. It will cost them about $400K to do it. LOL!

They pointed out that it is NY State law that business as well as home owners are responsible for maintaining all pedestrian thorough fares and sidewalk in front of their properties at their expense. So my job is to prove to them that our stretch of street does not qualify as a safe pedestrian thorough fare. Thusly it is not a sidewalk. I have to see how much property each land owner owns and where their boundaries extend to.
Like I have nothing else better to do with my day.

I don't think you're responsible for the physical integrity of the area (I think you said you re-blacktopped it a number of times). As far as I can remember, the first 8 feet from the street into your property is Government property, but the responsibility of the land owner to maintain (per the guidelines listed above).

I think I will have to retain one sometime in the near future to see if we have a case for Imminent Domain.

Well, that's what I'm getting at. If it were a roadway or sidewalk, the town would have maintained it over the years, not you. They have set a precedent that the area in question is NOT city maintained but property owner maintained. That makes it either a front lawn or driveway, not a sidewalk or street.

That is exactly what I am arguing, but that is where we fall short. There has to be a legal precedent to cover such a problem. So I have to possibly retain an attorney if the City Council doesn't want to rectify the situation themselves. The traffic Commissioner doesn't have the authority to amend the current laws to cover this situation.
