i can absolutely see where you are coming from based on the movie X-Men 3: The Last Stand.
In that movie it was suggested that Juggernaut could be a mutant based on the fact that he joined Magneto's Brotherhood of Evil Mutants.
I guess it's safe to say, however, that the movie strayed away from comic book cannon in this regard for the fun of it.
Unlike mutants, Cain Marko was not born with his powers.
Cain Marko's DNA was no different from normal human DNA when he was born.
There was no X-factor in Cain's genes; instead he was a homo sapiens just like you and me.
I think Charles explains this very well in the scene below when he states that Juggernaut acquired his powers whereas Charles' own powers are part of himself (caused by the X-factor in his DNA):
Cain received the power of the Crimson Bands of Cyttorak when he touched the fabled Crimson Ruby of Cyttorak in that deserted cave in Korea.
Juggernaut's powers are mystical by nature and they were granted to Cain by Cyttorak, a deity and the ruler of the Crimson Cosmos:
