ERB estate is pretty good at this and they've been doing it a long time.
You can get away with reproducing the original novels as they are public domain.
You can get away with adapting the original novels into new media forms. Dynamite did this when they did the Lord of the Jungle and Warlord of Mars comic series.
ERB couldn't do anything but stomp their feet publicly.
In the end, both sides came to a licensing agreement instead and Dynamite got the Tarzan and John Carter licenses.
But the characters are all individually trademarked as well. And that lasts forever.
Disney did much of the work in this regard and ERB estate know they have the backing of one of the richest companies on Earth who fight these legal cases until the end of time.
Many of Sideshow's licenses are Disney. They aren't going to get in a fight with the ERB estate over this.
I'm surprised they tried to get away with it to begin with.
Maybe they thought ERB only cared about the Tarzan trademark and wouldn't call them on this statue.
