I think the lawsuit by Fox to block the Warner's release of The Watcher may be in retaliation for multiple law suits by Warner's to block Fox's DVD plans for Batman. Maybe there will be some negotiating and ultimately an exchange of projects.

Well I think the difference in this case is it's a show that's 40 years old, and not available to buy in any way, so really if people want to watch/enjoy it these days there's really no other option available other than to buy bootlegs or to download it.
