The only thing I don't like about the pose is it looks like he's falling over..

The problem for me is that it’s suopposed to be from the Hush Unwrapped cover but the statue is too bent over on his left side. If it was just like the cover I would have pre ordered it.

This was the point I argued against in the product thread. The pose isn't different from the art. The photo is just tilted to match the exaggerated/foreshortened perspective of the gargoyles. In the photos that show the statue level with the ground, he doesn't look off-balance, apart from just having Lee's signature top-heavy anatomy.

i think its different..the art source is batman crouching waiting to swoop in..the statue is batman losing his balance but just caught his footing

It is a different pose from the art drawing. In the drawing Batman is clearly crouching with both legs bent but the angle of the viewer is below the horizon so you only see one leg bending by 15 to 20 degrees. The statue does look like he is about to fall over as he is climbing up on one leg.
