Disregarding a licensor's stipulations in a contract even while claiming to "protect" consumers would make any legal matters worse.
Technically Gaming Heads seems to be saying for customers to ask Sony for the royalty/licensing portion of their payments but construing it to imply that Sony is somehow preventing or impeding refunds. That indicates a fault of Gaming Heads.
There is no legal standing between Gaming Heads's customers and Sony or any licensor for that matter.
A message like this is pretty desperate.
Lawyers for huge corporations like Sony rarely would endanger their legal standing especially with something as pitiful as a toy designer. Whether this is financial mismanagement by Gaming Heads or an oversight in their contract that selling Sony licensed merchandise could be terminated at will, I feel fairly confident this is Gaming Heads faux pas.
