Pretty interesting NYTimes Biz Section article about the current Kirby Estate's legal proceedings against Marvel. Looks like the pivotal point will be proving Jack's art was "work for hire" or not.

why would they feel they should bet ANY money from wolverine?! He had nothing to do with the character.

i would think the newspaper writer used wolverine as an example and the kirby family did not specifically say that character. they would know wolverine isnt part of the kirby history.
