is it possible to get an XM statue
if i live in the states, is it even possible to order directly from XM? or do i have to go second party and pay double? looking in future obviously being everything is sold out

XM Studio's appear to spend ages showing previews, then without warning they make them available, and they appear to sell in seconds.
They don't appear to send out an email mentioning a pre-order a date/time.

No retailers will get shut down if they sell to you in the states. It's the marvel rules. And you have to po a year in advance of you want a hot statue.

Wrong.
BBTS, Spec Fiction and Secret Compass all sell XM statues. However, they are normally for exorbitant prices and all are still shipped from Singapore (so $300 shipping costs on top of their retail price) except for the Top Cow license.
Lucky for us N.A. customers even the Top Cow pieces are outrageous because said retailers tack on the cost they incurred for shipping on to the price.

Plain and simple is the price per statue is pretty equivalent to other companies for these 1:4 scale options.
It's the shipping that will kill you either secondary or straight from NA licensed products. Either the NA side retailers are adding it on, or you pay the same straight from Singapore.
I should add though that for worldwide licenses, it may be a bargain to try for a Prestige Membership bc of the discount. Who knows what licenses may either be announced as, or become, worldwide.
