i always wondered who's responsible for property damage.... someone has to be liable for that person that was struck in the head by falling debris.

of course im being sarcastic i've always wondered this as well.

I don't see any reason why they can't, in principle, be sued. Wearing a funny costume and adopting a silly name doesn't give you immunity from civil lawsuits or criminal prosecution.

There may well be difficulties in serving a costumed vigilante with court paperwork. Plus, unless they're government backed or very well funded (like the Avengers or Fantastic Four) they most likely won't have the assets or insurance to cover the cost of damages awarded.

A society where costumed superheroics are part of normal everyday life would have to have laws to take account of such activities, which something that Dan Slott's She-Hulk run looked at.

Superheroes should by property liability insurance, which I'm sure would have a "Superhero" rider much like California has earthquake riders and Florida has hurricane riders. Perhaps, homeowners and commercial property owners could buy Superhero damage policies.

Wasn't property damage one of the reasons for the Super Hero act of Civil War??
So that Super heros could be licenced??
