Penance went back to being Speedball years ago. He became one of the teachers in Avengers Academy, another book I liked.
Since that Hive cover for Contest of Champions is one of the many alternate realities from Secret Wars, that explains why he's still Penance there. It's not our normal Penance.
And I agree, Avengers Initiative was awesome. Such an enjoyable series with a ton of characters. It would've made an awesome tv show.

Same as with Penance, that art is an alternate reality. Ms. Marvel has never worn the exact same costume as the XM outfit in any comic. This is just cool cover art.
In comics now, Ms. Marvel became Captain Marvel with a different costume (check the recent sideshow PF) while a teenage character currently uses the Ms. Marvel code name.
Same with XM's Magneto, Wolverine, Iron Spidey, Daredevil, Thanos, etc...those exact costumes aren't in any comics. But XM's changes do all look good. Something like Magneto, that costume to me looks
better than any comic version. I like the changes to Iron Spidey as well.
