I returned my WW and now the 3rd party that I bought my WW from wants to state that the statue isn't defective (I don't think they know I have pictures of it) They want me to say that "I no longer want it" but that I should contact the manufacturer and see if I can get a replacement. Furthermore, they want to charge me a bit more besides the restocking fee and shipping charge because they claim that I returned it for the wrong reason...

File a claim against them. They can't tell you to get a replacement from the manufacturer and then also charge you a re-stocking fee.

Yep that's what I did Gothamite, I filed a claim 
crossing fingers here..
Gothie, if you received a statue that had googly eyes wouldn't you consider that defective?
