Spec Fiction question. [Issue Resolved]

A statue I ordered from them is many months past their preorder ship date. Comic-Concepts got it on time so it has nothing to do with a manufacturer delay.

I paid full price ahead of time but decided to cancel as it was clear they were never going to ship it. Then they said I paid a $295 deposit which I will not get refunded which is not true. I paid full price and there was nothing that indicated a $295 deposit on their site or on my receipt.

Is that basically the name of the game now with companies like this? Pretending they?re going to ship with no intention of actually doing so just to scam customers out of a deposit?

I filed with the Better Business Bureau but they don?t seem to have any teeth to do anything and Spec Fiction just ignores them. What other options do I have? Will filing an FTC complaint do anything? Or I?ll just have to go to their office the next time I?m in LA? Thank you for any advice on how to handle this!

Thats part of the deal with Spec Fiction its known in the community that it takes a few months after everyone else. I have a statue on order with them you just have to be patient.

I have been cheated out what 4,000 in PO on Ebay. 1 store
and scammers on sales
so IT SUCKS
corner store in Anaheim
700.00
they had a new store went there and they told me they had no info on my order. CROOKS
with ebay sales scammers and PO SCAMMERS
they tell you WHO CARES
long as buyer is HAPPY
just had another 250. was scammed out of
not really anything you can do
I AM SO MAD I HAD WAS SCAMMED OUT OF SO MUCH MONEY

STATUE COLLECTING SUCKS
have 30,00 in staties, and few are buying
shipping is alot
many scammers around
not statues but statue collecting

Not all retailers get their stuff at the same time. More often than not they ship well past their estimated dates.

I think they are legitimate. It does take awhile to get your order sometimes but in my dealings with them they've always been honest. When I have had an issues they've always done their best to make things right.

It will take them a while to get stuff (particularly p1 stuff) and even with full pay the deposit amount is the NRD.

Oof that’s a ton of money craigcliff1, sorry to hear that. I’m learning the hard way I’m way too poor for this hobby as $295 is a lot of money to me.

And I understand not all retailers get their stuff at the same time but when you’re talking many months to even years in some cases in difference, clearly they are not making any effort to get the product to you. And why would they I guess when they already have your money.

A lawyer is a good suggestion qz33 I just worry it will cost too much even with the connections my sister has working at a law firm. Another issue is I used this finance thing called Bread Pay which makes it more complicated.

I suppose I’ll file an FTC complaint and try to advise people to stay away from spec fiction on all of the communities I frequent. I have nothing but time while I’m working so I guess my only course of action is to make it hurt them way more than $295.

Do you know where it says that about NRD and full pay? I did not know there was a deposit when I did full pay as there was no indication of it. I scoured their site but can’t find anything on it or on my receipt/order details.

Yes when you are checking out it makes you click a checkbox to agree to their terms and under full pay it says this under the pre-order cancellation policy

PAY IN FULL
IF A PAY IN FULL ORDER IS CANCELLED WITHIN 24 HOURS OF THE ORDER DATE, A FULL REFUND WILL BE GIVEN. IF THE ORDER IS CANCELLED AFTER 24 HOURS, THE DEPOSIT AMOUNT FOR THAT PARTICULAR STATUE WILL BE KEPT, THE REMAINING AMOUNT OF THE ITEM PRICE WILL BE REFUNDED.

The time is what lets them offer the better shipping prices I imagine.
