Namor is a mutant but at the time the movie deals were set up he wouldn't have been associated with X-Men anyway as in the comics he hadn't become an X-Man yet and his mutant status was downplayed. He was alluded to in FF: Rise of the Silver Surfer so I guess at least Fox thought it was ok to use him, they seemed to be setting him up as a villain for a 3rd movie at Reed and Sue's wedding but that iteration of the franchise was scrapped.
Either way it seems from the info TethMau found that Namor is in a gray area... Not surprised since Namor is originally just his own character, but then was reintroduced and closely associated with FF for years, was then an Avenger, then an X-Man, and then more recently back on the Avengers side of things until Secret Wars. He's been all over the place.
