I don't think they ever had it in the first place. Apparently it was Sideshow 'lending' it to them.

Well they need to give it to them for good. At least with Prime 1 it appears to be worth the money. I also like their art direction. SS puts too much of their own spin on things and it pisses me off. I'm still waiting for a good 1/4 scale Thor & Cap. Classic look. None of that modern or old man version crap. I hate Alex Ross's art so having it in statue form is like someone kicking me in the nuts.

That was why P1 was buying I.A., but then I.A. didn't have license anymore so P1 bailed. SSC has the license and wont give it up, unless SSC thinks it's too much money they are going to keep.

SS is certainly never going to "give up" the license, unless they're pretty much getting out of the statue industry.
The only hope really is that P1 themselves can get a 1:4/1:3 license from Marvel, and I have to say I'm a bit surprised they don't have it at this point. Either 1) Marvel isn't interested in giving it for whatever reason or 2) P1 doesn't feel it necessary to try and attain it.
I don't know what the cost of that license would be but I'm not convinced it would be much more than what the total would be for them to get that and drop 2-4 of the other licenses that they currently have. Plus in the end I'd have to think their revenue would go up considerably.

I think SSC has worldwide EX license. IS has SA. XM Asia. P1 should have gotten the 1/3, but now LB has that.
