Duties are discretionary like most taxation. There is a great deal of statues and ornamental items made in Canada. And the statues wouldn't be subject to duty if they were made in the u.S. I'm not a fan of duties either. But I have no fight left.

The willingness of Sideshow to do something about this will be decided by their sales. If sales to Canada diminish in a noticeable fashion they will fight. If this has little to no impact on their sales, they won't bother.
It has nothing to do with doing right by their customers, it's all about money. Want sideshow to fight, cancel all your orders and stop buying from them.

So what code should be used at the end? I got an invoice for my Witchblade from UPS, and the HS code used is 9503009099.

I don't want to keep on harping on this but SS shipping is not in line with other companies. They are better. PCS and GG uses USPS to ship to Canada and it is double the cost. Last time I try to buy and item for BBTS the shipping was horrendous. I believe it was a 1/4 Yamato statue and it was $157 US and their boxes are not big.

I got my first invoice from DHL (never like it) for the P1 DKR, they are charging CAD 255.44 (6.5%) and they are using HS 3926.40.10.00.
They told me that I can dispute it but they will charge me an extra CAD 15.00 on top of whatever new value I got because shipper's mistake (Sideshow).

I asked SS to keep on using FedEx for me and they are, but they told me as more and more of their shipments to Canada will be by DHL, shipping cost will increase for FedEX.
What do you mean you were charged $255.44? Is that just for duty? Or is that duty, plus taxes? Or is that shipping cost, plus duty, plus taxes? That amount is high. What did you have shipped?

It is the P1 Batman DKR: 6.5% duty (76.66); 5% GST (62.80); 8% PST (100.49) and ~15 brokerage fee.

Ah, that makes sense. That thing was probably valued at $1300 cdn. You should file a claim for the right HS code and get your $76 back.

Which HS code they should use? Even if I win I will have to pay them CAD 15t.00 for the "mistake".
