Guys make sure you are checking your invoices. I just had 5 of 6 invoices wrong. FedEx entered other HC codes which one is for Plaster & cement and tobacco & liquor. Those were subject additional tariff taxes.

I contacted FedEx the first time and they said it was the exporters fault but when I looked at the commercial invoices, it had the right HC. I contacted CBSA and they said the broker have to fix it. FedEx needs to complete a B2 adjustment form to dispute the additional tax.

A little update and maybe good news

Okay,

I've went back and forth on this with CSBA & Fedex GTS Broker today.

I've finally got a clear explanation and I think I've found a way to make a case that they can't charge the extra 6.5% tariff tax.

Currently, SSC was asked to use 3926.40.10.00. From CBSA & Fedex, a general HC 9825.20.00.00 can also be used to replace 3926.40.10.00. Anything over $500 are subject to 6.5% tariff tax.

3926.40.10.00 refers to statuettes & other ornamental articles of plastic.

The old HC 9703.00.00.00 refers to original sculpture when SSC first used it. From CSBA, it can only be applied if the statue is 1 of a kind. So that is out of the question

The other HC that SSC used before was 9503.00.00.00. This refers to toys, dolls & figures etc. This is exempt from the tariff tax of 6.5%. Now here is a clincher for us. Under Sideshow Collectibles, it list all Premium Format as Figures. It also doesn't mention that it is a statue.

I am waiting to hear back from Fedex on this
I've emailed Fedex with attachment of a Hot Toys Figure Iron Man (which is a toy) & a premium format figure.

I've basically asked her what the difference is. Because both are figures, they must be toys. The 9503.00.00.00 should applied to this.

This is the only way we can get around this for Canadian buyers. Once it's confirmed by Fedex (and hopefully it goes in my favor), I'll contact SSC to make a case that they need to change the 3926.40.0000 to 9503.00.00.00.

It'd be great if this could get straightened out. Normally I bristle at my statues being called toys, but if it saves me some dough, then I'd even let them be called dolls!

If the "dolls" have mixed material and uses cloth, then it is not all plastic as 3926.40.10.00 states it is. It essentially makes the statue like a doll. I am challenging FedEx on this....


^^^And thanks guys. I would do this for any fellow collector when I believe the government is trying to cheat us from more taxes that they don't deserve.
