Sculptor Erick Sosa had designed this Spider-Man statue for Kotobukiya few years ago. And he posted the following earlier on the FB page of Hero Complex Gallery.

Here is a comparison shot that makes it easier to highlight the similarities. I mirrored the image, shrunk it a little and converted to greyscale. The eyes, position of the arms have been modified and few other details have been retouched, but the overall whole body pose including some of the crease lines are directly taken from the statue image.
John Aslarona's piece is cool and most wouldn't mind if the art was based on the prior comics or movies, but when it's directly taken off from another artist's new creation it won't bode well with many.
