No lean on mine either. Displayed mostly with cape for like 6 months. I won't kid myself though. Could be months or years, but I figure gravity will have its way eventually. Then I'll break out the fishing line because this Batgirl is just too good.

Here some pics from my Batgirl. Received her in April or May I think.

When I first saw the prototype I knew leaning is going to be a thing. So I'm not really bothered by it.
XM did good by adding the beam as support.

As soon as she touches it though, I'll add a tiny piece of soft cloth, to prevent any rubbing due to natural vibrations.

Damn, since I have heard about this issue, I have the impression that my Batgirl has started leaning too. I could swear the gap was bigger when I assembled her for the first time. But it could really be just my imagination. Im am really worried now.
Fact is...the response from XM is pretty weak. This should have been tested and prevented in development.

I read on facebook that two people had museum pose Batman statues that started to lean back. Is nothing safe?

Nope. Unless a statue is made of metal, stone/rock, or marble, the materials used in pop culture statues are susceptible to warping due to heat or even water. When I was new to the hobby, I looked up "cold cast porcelain" on the Internet, and it can dissolve in water. Metal rods provide some structural integrity but don't really make polystone or cold cast porcelain "stronger".

Just picked her up and I must say this is grail worthy. I do feel the base is too large but the statue itself makes up for it along with all the switch outs. Super bad sculpt.

That's the first I've heard of that statue leaning, I'm usually skeptical until I see some pictures.

Environmental conditions must play a role in this as I've seen several pictures of TH Harley leaning yet mine is still fine. The only statue I own that has leaned has been the original Poison Ivy plant heads. They're all looking down now
