No no no... they are clearly different. Didn't you go to the site to see the extra views?
This one is clearly inferior.
(not that I blame the one who sculpted it, but the pose looks off to me. It's just awkward instead of powerful, like the SS version.)

Not really.
I bought the movie soundtrack and this very pose is on the CD booklet.
In fact plenty of movie promo materials have feature movie version Ironman in this pose.
This pose doesn't belong to a single individual nor to a company, it belongs to the character so I really don't see how you can call this a plagiarism.
If Attakus indeed bought the license it is their right to choose from the poses available as long as Marvel approves.

Well, it is the movie Mark III instead of the armor in the SS piece, but it seems kind of clunky and rough in comparison.
I would have to see it in person.

I think they really strived to underachieve on this one.

Whilst maybe not plagiarism, I think that the fact that there has already been a very successful statue released that is in this very same pose makes it a poor choice if they were wanting to make something that would stand out.
Although, seeing as how the SS statue sold out and is rather sought after, maybe they thought that they would make a killing selling them to all those people who missed out on the SS statue.
