If his claims are true shouldn't his parents be charged with distribution of pornography? They got paid for the picture.

Fkin ridiculous- why doesn’t he then just sue his own parents for the compensation that they got as they were legally in charge of his wellbeing etc etc ….. and additionally he admittedly got some sort of gain ( possibly compensated in some way ) from the album over the years when stated : “ Elden has repeatedly recreated the pose as a teenager and adult, diving into pools to pose (with swim trunks on) on the occasion of the album’s 10th, 17th, 20th and 25th anniversaries. However, in most of the interviews accompanying these photo shoots, he expressed deeply mixed feelings about being famous for the “Nevermind” cover and whether he was exploited by it. Until now, despite his ongoing ambivalence about the photo’s legacy, he hadn’t described it as pornographic.”

So if he himself as the complainant hasn’t even described it a pornographic in nature then how does the lawsuit have any ground to stand on.

Also lets suppose that his parents received 200K instead of 200 bucks as compensation…legally I’m not aware that he is entitled cite any specific compensation that he or his parents “should have” received regardless …. I’m interested to know why no mention of the parents position and what their testimony is on the details of their opinion on the authenticity of their sons lawsuit….

That all being said it is 2021 and IF there is any hardcore evidence of deliberate sexualized exposure related to this photo shoot in a sexualized context ( no matter how faint ) then he will have grounds to stand on - BUT I’m pretty sure that WILL REQUIRE his parents personal testimony relating to what they witnessed or heard ( or anyone else who was involved in the photo shoot itself ) which will in fact automatically put themselves in the spotlight ( especially if accused of allowing such abuse to occur ) ….

But most likely it will be appealed as the compensation of $200 PLUS “ “Geffen Records sent 1-year-old Spencer Elden a platinum album and a teddy bear.” will be cited as evidence of compensation that the family did not reject but accepted. In addition the fact that even up untill 2016 the complainant was making gain ( whether by being famous or other “perks) that alone is cause to assume he was accepting of the ongoing perks and benefiting from his fame -

It always comes from the horses mouth and that surely will be shown when he states “ In 2016, the last time Spencer recreated the pose as an adult, he told the New York Post, “The anniversary means something to me. It’s strange that I did this for five minutes when I was 4 months old and it became this really iconic image. …. It’s cool but weird to be part of something so important that I don’t even remember.”

Spencer Elden, 25, wanted to go au naturel when he made a splash to honor the legendary grunge band, he told The Post.

“I said to the photographer, ‘Let’s do it naked.’ But he thought that would be weird, so I wore my swim shorts,” said Elden, an artist from LA.

THIS GUY IS A BULLSh*$TER - FKIN RIDICULOUS….

So is he or is he not disgusted with his exploitation that may or may not be sexual in nature or not?! Its kinda hard to tell from his quoted statements. He really contridicts himself when he states things like “ In a Time magazine article on the album’s 25th anniversary five years ago, Elden, then 25, said, “I got a little upset for a bit” as he grew older. “I was trying to reach out to these people. I never met anybody. I didn’t get a call or email. I just woke up already being a part of this huge project. It’s pretty difficult — you feel like you’re famous for nothing, but you didn’t really do anything but their album.”He said then that he recognized the cover concept was “genius” — and, in fact, had the “Nevermind” emblem tattooed on this chest”. — DUDE SOUNDS CONFUSED LIKE CANT DECIDE IF HE IS MAD ABOUT IT OR NOT!

If anything he will succeed in getting his parents in trouble for allowing any perceived sexual harm to come to him but its still a thin case as there are way to many contradictions in his statements and actions over the years…..

Authenticity and proving sincere mental trauma and physical sexual abuse will be key in getting this case off the ground at all. His parents will be ultimately responsible to be accountable whilst he was a minor at the time of the occurrence. Sounds like a super hot 2021 mess of a case for sure and this guy appears to be a straight up idiot….

Its obviously just a money grab and a terrible one at that. He listed a band member that left the band before the album and picture were even taken.

This dude is really bitter all of a sudden for being on one of the most iconic covers of a generation from a band that lead a musics movement. Maybe he is going through something, but he should really direct his energy to something more logical.

If the dreaded FCC could let the cover go, how bad could/can it really be? Lord.

He's pissed because he tried to get the band to be a part of his art show and they didn't respond. It's a revenge tactic.

This psycho has the album name tattoo'd on his chest. He uses his image as a joke to try and pick up women. He's recreated the album image multiple times over the years, even once wanting to do it nude.

The plaintiff still has ten days from the ruling to refile a second complaint against Nirvana though. If he misses that deadline then the case will be dismissed without prejudice--no chance of refiling.
