Culture Shock Toys Refund

Looks like PCS is trying to make things right.......

Dear Collector,

We wanted to give you an update on your refund status. As a matter of public record, PCS Collectibles currently has two lawsuits pending against Jerry Macaluso (the previous owner of Culture Shock Toys), including an action seeking to recover distributions Mr. Macaluso took from Culture Shock Toys prior to the sale. We believe those distributions to include deposits and pre-payments made by customers.

The actions, which are pending in North Carolina and Nevada, are proceeding towards trial. However, due to the Coronavirus, the scheduled trial dates in North Carolina and Nevada have been delayed. Recently Culture Shock Toys successfully had Mr. Macaluso’s claims dismissed on summary judgment. All that is now remaining are PCS Collectibles and Culture Shock Toys’ claims against Mr. Macaluso. While the companies are optimistic, receiving a judgment after a trial is often the first step, as losing parties will file appeals and potentially explore bankruptcy. This is very unfortunate and might interfere with our ability to get the refund money into collector’s hands.

In light of this information, we want to offer collectors waiting on refunds another option. Since PCS Collectibles never received the money for products purchased from Culture Shock Toys, any cash refunds due would still be on hold until after both cases are decided. In the meantime, in lieu of a cash refund, we would like to offer you a PCS product credit (not Sideshow credit) in the amount of your requested refund for new preorders and towards the shipping of those orders. If you accept the PCS store credit, we will also give you a 15% discount on any products ordered using your credit. Please let us know by 06/12/2020 if you’d like to take advantage of this opportunity by emailing storecredit@pcstoy.com, listing the email address you used for the original purchase, the item(s) purchased and the expected refund amount.

After 06/12/2020, we will review/verify all the credit requests and will provide you with a credit amount and store credit code. We will also provide details on placing your orders at that time as well. We will try to get the store credit code emails out as quickly as possible after 06/12/2020. We sincerely appreciate everyone’s patience while we slog through the process.

Sincerely,

Culture Shock Toys, Inc and PCS Collectibles, LLC

Please note: This mailbox is only for store credit requests. This mailbox is not monitored for questions.

Pretty suprising hearing this during the pandemic.
Sounds pretty fair to give you a PCS credit option, eventho Jerry seems to be the one owing you the money.

I wonder just how many collectors are still waiting on refunds for them to make this option available. Still, PCS credit and a discount is better than silence (assuming said collectors are still interested in PCS’s current offerings).

Soon the FBI will be on the hunt for Jerry, but they'll never find him on his private island. This was all part of his plan.

It astounds me that Jerry built PCS and would screw everyone of the $. Just doesn’t make any sense.

I doubt that's his intention however bailing when things get rough and taking what you think is owed is common ;p Dunno how it really went however there are plenty of statue companies who have done just that.

I went to a general store. They wouldn't let me buy anything specifically.

Doubt they are doing this in your best interest they must be low on cash for this to come out of the blue. Either way if they have products you want this is great news

Side note jerry is selling his statues mostly AP on various groups. He has I believe all the classic mk statues the ones that were “long sold out”
