A statue absolutely CAN be "used" condition. There are many issues a displayed statue can have that a new one does not. Conversely a properly opened and inspected statue not displayed to me is "better than new" as sealed can have hidden issues as well.

I paid a premium for a brand new collector's item, which turned out not to be the case. It also has flaws that cannot be fixed (like a missing ring).
That's why I'm returning.
They probably purchased this one to make their fakes and are just reselling which may explain the issues. Honestly, I would keep if they offer a partial refund and have someone 3d print you a ring, not worth the risk returning it if you think it is a real JND.

The partial refund offered is minimal, not enough to compensate for what I paid.

It doesn't seem there is much risk in returning if I use a tracked return like UPS. Once delivered via UPS, eBay will acknowledge the return, even if the recipient refuses to sign.

But since you are curious, here are some photos of issues... There are more, but the point is I paid for a brand new item (above retail price), not a used one.

95% of the time eBay sides with the buyer. Unless the buyer repeatedly does the same questionable acts. It basically sucks being a seller on that site lol. You can literally say no returns, but the buyer can return it regardless because of the eBay guarantee. You could make a contract with the buyer, but can be erased with that eBay guarantee lol. Doesn?t matter.

As for the China fakes, it’s night and day if it is or not. It’s so easy to see if it is fake or not. Always look at the sellers ratings and feedback. Ask for extra pics and look at the packaging. If anything the buyers are really shady. They will have a broken item they F’d up on and then buy the same item on eBay. Claiming it came broken and then replacing their broken item with the good item they bought lol. EBay sucks.
