Even if Marvel had the license do you think they would risk getting sued by using such a minor character in their films.

This is not unlike both companies having Quicksilver, except here it's two completely different characters with the same name, but who share no relation to each other other than the name. I think Marvel will be free to use the character if they choose to do so.

You do realise they are two completely different characters with different team affiliations. Also take account that Scarlet Witch/Quicksilver can appear in both Xmen and Avengers.
In saying all that I cannot see them making it into any movie in the near future.

Still, his powers are quite similar to FF HT and he has the same name. So even if Marvel decides to use the character, they would have to make a deal with Fox to prevent future headaches anyway.

Well, I don't know what their contracts say, but unless they specifically included this character in Fox's deal for FF I don't see them cutting any deals for the character if they don't need to. And based on the picture from Captain America that Bullseye posted above I'd say Marvel probably does have access to the character. Guess we'll have to wait and see.

I'll have to watch that video again in HD but from what I saw I think an Agent Carter series done in that style would be awesome.
