Now that is bizarre. Maybe the guy should have been compensated more than just $200, a platinum album and a teddy bear however I do wonder how far something like this lawsuit will even get. Any attorney's on here who could offer their opinion?

If it doesn't get thrown out it is going to open an entire new wave of lawsuits. I can see anyone used in a commercial or advertisement of any kind that were under the age of 18 seeing their chance for a cash grab.

Apparently not. The parents were happy with an on the spot $200 ca$h grab. End of.
The baby/now adult on the album cover is playing the porn card? ..really?
'Elden (the baby on the album cover) has said he was never compensated for the photo beyond the $200 his parents were paid for it on the day of the shoot.'

I'm sure the photographer had a contract with the record label. If anything the photographer may be in trouble for no paperwork with the parents, but to say the cover portrays an under age sex worker is ridiculous.
Add to the fact the guy who was the baby in the photo has used the fact "He was the baby on the Nevermind cover" to his advantage. He has redone the photo as an adult on several occasions. I'm sure he didn't do that just for the hell of it.

If nudity inherently equates to pornography then every art museum I've been to will be in trouble.
This album came out 30 (geez I'm old) years ago and never once did I hear anyone think this way. It was available all over at any place that sold records.
I think some attorney figured "I can drum up some press (evident by us discussing it) and maybe make a quick buck off people who want this to just go away".
I see this as a form of opportunistic extortion and hope it is thrown out and the attorney brought under scrutiny for frivolous suits.

I remember seeing an interview with Vanessa Williams years ago with Oprah and she said that she never signed a release for the photo's of her that were in Penthouse while she was Miss America that had been taken years prior. At the time since those photo's cost her so much but she never pursued a lawsuit against either the photographer or Penthouse.
I guess if a release was never signed it could be possible there could be a lawsuit but I would wonder why has this not been brought up say 29 years ago when Nirvana was the hottest group on earth at the time.

Why wait 30 years to complain?
If anything does come of this, maybe the band/record company might decide to create a new art for the album cover, and make even more money from collector types
