Matt would sense, through Batman's fighting stance & technique, that his back had been broken at some point in the recent past. Batman himself wouldn't even perceive that his old injury was micro-evident. Matt would kick the exact same spot, the back would re-break and re-cripple the Bat. That would do it. Matt for the win.
