Sorry, I just don't have a lot of tolerance for people that aren't paying attention this late in the game.

FROBAY may have posted the request on 04/28 but there were a few posts leading up to that prompting people to pay attention and that emails would be requested soon, the last of which being posted on 04/17 and 03/11.

It's enough work putting all this together, collecting all of the payments, packing and shipping these that the last thing we want to do is hunt people down via PM and email at the 11th hour when we have a thread dedicated to communicating with the group.

The general mentality over there is that everything should be priced like a mass produced general release print. The point everyone seems to be missing is this is a private commission. Unless you're in the group, you're owed absolutely nothing!!

At the end of the day, an artist is free to choose any amount they damn well please for something they created and APs they own. If they don't sell at those prices, it is his problem and he will either sit on them or lower the price points. As usual, most of the comments there stem out of butthurt/jealousy. His responses on FB certainly didn't help the situation but I probably would have done the same thing if people attacked me regarding something that was none of their damn business. I could see him losing some potential customers over it in the end, though, which is unfortunate.

Bold statement. I would say there are many that talk tough and change their tune as soon as the next piece comes out they like. But some collectors tend to hold a grudge on stuff like this, you can ask Mark Englert about that (different situation but similar outcome).

Even though I wasn't planning on it I'm considering picking this up now. I've always been a big fan of the art on this one but sold my original copy a while back. I actually think the color composition works better on this Scarlet Variant too.

Question though, I know those that ordered the regular or variant of this before get $10 off and I did receive the email, which I think contained a coupon code, but I deleted it thinking I wouldn't use it. Anyone recall what the code is or will the $10 just come off automatically since I ordered the original? Thanks!

Not exactly. Ran into some problems at the printers, it's currently being sorted. We'll update you guys when we can.

So here is the latest on these and unfortunately it comes with a bit of bad news. These went to print and for various reasons, which I'm not going to get into the specifics of right now as the situation is still very fluid, Nakatomi Inc. botched the printing job.

As a result of this we're currently in the process of moving the printing of both 'The Avengers' and the 'Dark Guardians Variant' to another company. They are local to me a very clean and professional. I will be stopping in at Lazarus thru the printing process. Expect a kick-ass print!! This pushes us out 2-3 weeks.

I've got an important announcement to make

As you all know we recently had an issue with Tim Doyle of Nakatomi Inc. in regards to printing our Avengers commission. In a nutshell he basically botched our printing job and was trying to force us to take his shoddy work. We flat refused and demanded he either reprint the run, at his expense, or refund us so we could take the project elsewhere. He fought us on both counts. Not wanting to admit fault and not wanting to take a hit financially for his screw up. After a lot of back and forth he finally conceded and granted us our refund, we moved on, thinking we could just put it all behind us. The project is now in good hands but the defective prints were in the hands of Tim Doyle. He assured us he was just going to recycle the paper so he didn't lose money on the botched print job. Since he was holding the group's money hostage we had to trust he'd be a man of his word as it was the only way we'd get 100% of what we gave him back. Well, he's isn't a man of his word. The following week after all this went down he had his Mystery Tube sale where he inserts random prints into a tube for a flat price. Rather than destroying our botched run he trimmed them down to 18x24 and sold them in his tubes unbeknownst to us. Until today that is when we noticed several up for sale on eBay.

While this is now beyond our control that doesn't mean we're going to let him get away with this unscathed. We're creating a thread on EB slamming him, his reputation there matters to him and we're encouraging anyone here who is an EB member to chime in. Either FROBAY or myself will post a link to the thread once he has created it.

Also, we are reporting all the auctions on eBay as this work is a reprint/fake of a private commission. I would encourage all of you here that are eBay users to do the same as the more reports that come in the better as it will be hard for eBay to ignore.

This is all very unfortunate. Please know that both FROBAY and myself did everything we could to keep something like this from happening. We thought after Guardians this commission was in good hands but we quickly realized after encountering some problems that Tim Doyle did not have our best interest in mind this time around.

The 18x24 circulating by Tim are stamped scratch and dent and are worthless in my opinion. Our group will have the real deal.

I wouldn't be surprised if many printers are printing extras to sell on the low. I know for me and the commissions i've been in, it seems there are more than expected prints hitting the aftermarket, alot of people blamed commission leads, but it could just as easily be the printers.

Thought about this a bit and just for intellectual discussion, I doubt this would be considered theft or stealing bc the posters did not belong to the artist or commissioner since they were not paid for. That's why it's either breach of contract (he wasn't supposed to keep the posters and he did) or copyright infringement (he sold or distributed art that is copyrighted by Alex)

Everybody is a comedian and the Tim Doyle thread itself is full of brown nosers & apologists. Their analogies are laughable. Comparing our situation to buying a t-shirt? :laugh:

I made my post laying out just the facts knowing full well most would still claim Tim did nothing wrong or that we're making something out of nothing. It doesn't make a difference how clear a picture you paint for these fools most will have a complete lack of sympathy or even the capability to understand that we were deceived, Tim capatilzed on his mistake and despite finally providing us with a refund set us back to square one in terms of printing. This whole situation is very off putting and really reinforces my disdain for EB and its membership. In this last month I have had nothing but extreme grief negotiating 2 innocuous poster deals that both fell through over there despite affording the lions share to the other party. At the same time I sold two rare statues to members here and would easily have them stay with my family if they came to see the mountains, the transactions were that pleasant.

Those are the bastardized versions of our print that Tim sold in his Mystery Tubes being resold by those that purchased them. There was nothing "scratch and dent" about them, that's just how he labeled them since they've been trimmed down. All the flaws in the alignment, color bleeds etc., that were there when we refused them are still present. The quality of our prints will be far superior to this hack job.

Our prints will be shipped in a sturdy Yazoo Mills tube carefully rolled with craft and tissue paper. Anyone who was in on the Guardians commission can attest to the quality of the packing.

Honestly the metallics don't pop out strong, good lighting brings them out best. Doesn't take anything away from the amazing print.
