Severance Package Negotiation

Hi guys!!

I need your advice. My company will lay me off by the end of october. This will be my first lay off throughout my whole life. It will be tough for me. Anyway, I wll be getting a severance package. How do you guys negotiate the package? (Not sure if you guys ever dealt with this kind of situation)

Do I need a lawyer to negotiate? If I do need one, how do I find a good lawyer? Any lawyer in New York that you guys can recommend would be great. Please pm me the lawyer that you recommend.

I have no clue how this whole negotiation works.

Most of your questions will require more info, such as:

1) Position (executive or regular worker bee)
2) Years with company
3) Pre-existing agreements

I don't have any experience with negotiating, but anyone helping you out would ask these basic questions.

I never heard of negociating a severance package... usually a severance package is up to the company to give but they are not required to give it...

I never got an opportunity to negotiate a severance package when I got laid off by ING back in Sept 2007. They had a company policy, 2 weeks for every year of employment (which came to 30 weeks for me), paid the same portion of health insurance during the 30 weeks as they did while employed, got all my vacation/sick pay. Everyone laid off got the same package.

Unless at the executive level where usually contracts are involved.

WOW! 30 weeks?

My company has a standard package of 2 weeks per year also. I read something about negotiating severance package on one website, they said "Don't take it and leave it." I dont remember which website. By negotiating, I have nothing to lose anyway.

This is really tough.

Ours use to be 2 weeks for every year but then they cut back to 1 week cause they are cheap asses.
